The Wheel Surgeon – Terms and Conditions
These Terms and Conditions (“Terms”) govern all services provided by The Wheel Surgeon (“we”, “us”, “our”). By booking or accepting our services, you agree to be bound by these Terms. If you do not agree with any of these Terms, please do not use our services.
A non‑refundable deposit of £50 is required for all bookings. This deposit will be applied to your final payment only if these Terms are fully complied with. Failure to adhere to these Terms may result in the deposit being forfeited as liquidated damages without prejudice to any other remedies available to us.

1. Booking and Deposit
1.1 A non‑refundable deposit of £50 is required to confirm your booking.
1.2 The deposit will be applied toward your final payment provided these Terms are complied with.
1.3 Cancellations made with less than 72 hours’ notice will result in the deposit being retained.
1.4 Failure to comply with these Terms may result in the retention of any deposit paid, without limiting our right to seek further remedies.

2. Mobile Service Requirements
2.1 Adequate parking space must be provided to accommodate our service van.
2.2 The service location must provide a functioning, accessible electrical socket within 20 metres to power our equipment.
2.3 Should these requirements not be met, we reserve the right to cancel the appointment, retain the deposit, and charge a £50 call-out fee.
2.4 We accept no liability for any damage or loss arising from unsuitable or inadequate service conditions.

3. Alloy and Caliper Disclosure
3.1 You must disclose if any alloys or calipers have been previously refurbished, sprayed, or otherwise altered in any way that might affect our service.
3.2 Failure to provide accurate or complete information, including clear images where requested, may lead to additional charges and/or suboptimal outcomes for which we shall not be held liable.

4. Repair Limitations and Quality
4.1 While we endeavour to restore your alloys to an acceptable condition, severe damage may limit the repair outcome, and minor imperfections may remain despite our best efforts.
4.2 No repair under these Terms is warranted to achieve a flawless or factory‑like finish, particularly where significant prior damage exists.

5. Physical Repairs Warranty Disclaimer
5.1 Welding and buckle repairs are provided solely as temporary solutions intended to restore road safety and are not permanent repairs.
5.2 Such repairs are inherently subject to external factors—including driving conditions and environmental exposure—and are not guaranteed against subsequent deterioration.
5.3 The Wheel Surgeon expressly disclaims any warranty, express or implied, on welding, buckle straightening, or similar repairs, and shall not be liable for any further deterioration, structural failure, or consequential damage.
5.4 For a permanent solution, replacement of the alloy wheel is strongly recommended.

6. Customer Obligations
6.1 You must provide accurate and detailed information, including clear photographs of the items to be serviced.
6.2 Any misrepresentation, concealment, or error in the information provided may incur additional charges and may relieve us of liability.
6.3 A locking wheel nut key must be provided for us to complete the service; failure to provide such will incur a £75 call‑out fee.
6.4 If wheel nuts are not removable, removal fees will be charged at the following rates:
– Standard wheel nuts: from £20
– Locking wheel nuts: from £60 (charged upon removal)

7. Punctuality, Preparation, and Cleanliness
7.1 You must be present at the agreed time and location for depot or mobile services. A delay of more than 30 minutes will incur a £20 late fee.
7.2 All alloys must be cleaned prior to our arrival; should the alloys not be cleaned, a cleaning fee of £10 per wheel will be applied.

8. Caliper Painting and Workshop Services
8.1 Caliper painting or similar work is conducted exclusively at The Wheel Surgeon Workshop or under conditions we have expressly approved.
8.2 Should the working environment be unsuitable for safe or quality work, we reserve the right to decline the service and retain the deposit.

9. Cancellation, Rescheduling, and Amendments
9.1 A minimum of 72 hours’ notice is required to cancel or reschedule any booking.
9.2 Rescheduling is subject to availability and may incur additional charges.
9.3 Any amendments to these Terms will be communicated in writing. Your continued use of our services after such notice constitutes acceptance of the revised Terms.

10. Corrosion, Pre‑Existing Damage, and Limitations
10.1 If corrosion or other pre‑existing damage is present and not disclosed at the time of booking, we will endeavour to address it; however, any residual imperfections shall be deemed accepted.
10.2 The Wheel Surgeon shall not be liable for any issues arising from undisclosed corrosion or pre‑existing damage.

11. Third‑Party Work and Warranty Voidance
11.1 Any work performed by third parties on the alloys, calipers, or areas previously serviced by us will automatically void any warranty or guarantee provided under these Terms.
11.2 We shall not be held responsible for defects, damage, or issues arising from subsequent third‑party work or modifications.

12. Issue Resolution and Complaints
12.1 Should you have any concerns regarding our work, you must notify us in writing within 7 days of service completion.
12.2 We will review any reported issues and, where appropriate, endeavour to rectify the problem.
12.3 Failure to notify us within the stipulated period will be deemed acceptance of the work as completed.

13. Quotations, Estimates, and Additional Costs
13.1 All quotations are based on the information and images provided at the time of booking.
13.2 Should the actual condition be found to be worse than originally described, we reserve the right to revise the final price accordingly.
13.3 Any adjustments will be discussed and agreed upon before further work is undertaken. Should you refuse to proceed with the additional work, the deposit shall be forfeited.

14. Payment Terms and Late Fees
14.1 Payment is due immediately upon completion of the service unless a prior written agreement for deferred payment or a payment plan has been made.
14.2 A £30 late payment fee will be applied if payment is not received within 7 days of service completion.
14.3 Continued non‑payment may result in the accrual of interest and the recovery of legal costs.

15. Limitation of Liability and Disclaimers
15.1 The Wheel Surgeon’s liability is strictly limited as follows:
a) We shall not be liable for pre‑existing damage, corrosion, or any undisclosed faults;
b) We shall not be liable for loss of use, incidental, consequential, or indirect losses arising from the service;
c) We shall not be liable for any damages, costs, or losses arising from third‑party work or subsequent modifications.
15.2 Our aggregate liability, in any event, shall not exceed the total fee paid for the service.
15.3 Notwithstanding the foregoing, nothing in these Terms shall exclude or limit our liability for death or personal injury resulting from our negligence or for any liability which cannot be excluded or limited by law.

16. Force Majeure
16.1 We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including—but not limited to—severe weather, equipment failure, industrial action, or road incidents.
16.2 In such events, we will endeavour to reschedule the service at the earliest opportunity.

17. Entire Agreement and Severability
17.1 These Terms constitute the entire agreement between you and The Wheel Surgeon and supersede all prior agreements, representations, or understandings relating to the subject matter herein.
17.2 Should any provision of these Terms be held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Notices and Communication
18.1 All notices or communications under these Terms shall be in writing and deemed properly served if delivered personally, by post, or via electronic means to the addresses provided by each party.
18.2 It is your responsibility to ensure that your contact details are accurate and up to date.

19. No Waiver and Assignment
19.1 No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver thereof.
19.2 We reserve the right to assign or transfer these Terms, in whole or in part, without notice to you.

20. Governing Law and Jurisdiction
20.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
20.2 Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

21. Consumer Rights
21.1 If you are a consumer, these Terms are subject to the provisions of the Consumer Rights Act 2015 and any other applicable consumer protection legislation.
22.2 Nothing in these Terms shall affect your statutory rights as a consumer.
